3. Legal status and limits of our involvement
Capital Foncier acts as a land marketing company and as a digital platform supporting real estate investment. Within all our contracts, the following status applies without exception:
Capital Foncier is not a notary
All escrow operations, registration of deeds in the Land Registry, and milestone-based release of funds are carried out by an instrumenting notary, who alone decides as conventional escrow holder (Article 1956 of the Ivorian Civil Code).
Capital Foncier is not an OHADA security agent
Within the meaning of Article 5 of the OHADA Uniform Act on Securities, Capital Foncier does not act as a security agent. The registration of securities (conventional mortgage, commissory pact under Article 199 OHADA Uniform Act on Securities) is held by the notary on behalf of the buyers, or where applicable by an independent third-party security agent.
Capital Foncier is not a credit or payment institution
Capital Foncier does not carry out banking activities, does not receive repayable funds from the public, and does not provide payment services within the meaning of Law 2018-572 on UEMOA banking regulation. Funds transit through the notary's CARPA escrow account.
Capital Foncier is not a CIMA insurance intermediary
Capital Foncier does not distribute insurance or financial products within the meaning of the CIMA Code. Capital Foncier's contractual commitments (repurchase commitment on land sales under Article 1659 of the Civil Code, processing-fee refund commitment on pre-sales) are common-law contractual commitments, distinct from any insurance coverage.
Capital Foncier is not a real estate developer
Capital Foncier is not a real estate developer within the meaning of the Ivorian law on real estate promotion. The pre-sale programmes presented on this site are carried by land developers holding an MCLU licence; Capital Foncier handles their commercialisation and operational follow-up alongside the developer, on its own equity, without public solicitation of savings or third-party fundraising.
This qualification is essential to a proper understanding of our role. Any contrary wording that may appear elsewhere on the site must be read in light of this status.
4. Intellectual property
All content on www.capital-foncier.com (text, images, graphics, logo, icons, photographs, videos, audio, software, databases, layouts) is protected by Ivorian and international intellectual-property laws, notably Law no. 96-564 of 25 July 1996 on the protection of intellectual works and copyright in Côte d’Ivoire, as well as the revised OAPI Bangui Agreement.
Any reproduction, representation, modification, publication or adaptation — in whole or in part — of these elements, by any means whatsoever, is prohibited without the prior written authorisation of Capital Foncier. Any unauthorised use shall be deemed an infringement and prosecuted in accordance with applicable law.
5. Limitation of liability
Capital Foncier strives to provide information that is as accurate as possible. The company cannot, however, be held liable for omissions, inaccuracies or shortcomings in updates, whether caused by it or by third-party partners who provide this information.
The information published on the site — including land descriptions, indicative prices and instalment terms — is provided for informational purposes only and does not constitute a contractual offer. Only the contractual documents signed between the parties prevail.
Capital Foncier shall not be liable for any direct or indirect damage resulting from access to or use of the site, including unavailability, data loss, deterioration, destruction or viruses that may affect the user’s computer equipment.

The collection and processing of personal data carried out from this site is governed by Law no. 2013-450 of 19 June 2013 on the protection of personal data in Côte d'Ivoire, and by the General Data Protection Regulation (GDPR — EU 2016/679) for users residing in the European Union.

In the event of a dispute, and after attempting an amicable resolution, the courts of Abidjan (Côte d'Ivoire) shall have exclusive jurisdiction.

10. Published dataset sources
Capital Foncier publishes certain datasets sourced from Ivorian public authorities. This data is made available for informational purposes, in line with the principle of access to administrative information. Any reuse is permitted subject to citation of the source.
Approved urban subdivisions (MCLU)
Data on approved, cancelled or suspended urban subdivisions published on the /outils/lotissements page comes from the Ministry of Construction, Housing and Town Planning (MCLU) of the Republic of Côte d'Ivoire. Capital Foncier handles its collection, formatting, geocoding and public dissemination.
Reuse authorised with attribution. Any citation or reuse must mention « Source: MCLU, formatting Capital Foncier » and link back to this page. The data remains the intellectual property of the Ivorian State (administrative public information).
Market values of urban land (DGI)
The price-per-m² ranges published on the /referentiel-valeurs-marchandes page come from the General Directorate of Taxes (DGI) of Côte d'Ivoire — 2023 fiscal annex. Capital Foncier handles its formatting and public dissemination.
