2. Personal data collected
Through our land and real-estate intermediation activity, we collect different categories of personal data depending on how you interact with our site and services.
Online forms
When you complete a form on our site (diagnosis form, instalment-plan eligibility form, contact form, information request), we collect the information you voluntarily provide: first and last name, email address, phone number, desired location, budget, professional situation, monthly income (for instalment-plan eligibility) and any other information you choose to share.
Navigation data
When you visit our site, we may automatically collect technical data: IP address, browser type and version, operating system, pages visited, visit duration, traffic source and cookie identifiers. This data is collected via cookies and similar technologies.
WhatsApp exchanges
When you contact us via WhatsApp to obtain information about the plots we offer or our services, the exchanged messages, your phone number and your profile name are processed as part of the commercial relationship. These exchanges are subject to WhatsApp's terms of use (Meta Platforms, Inc.).
Data specific to pre-sale programmes (KYC)
If you reserve a plot under a pre-sale programme, additional data is collected for the pre-notarial reservation contract: ID document (front/back), proof of address less than three months old, bank details (IBAN or RIB), proof of source of funds where applicable. This data is strictly necessary for contract conclusion (legal basis: pre-contractual measures at your request) and is shared with the instrumenting notary, who also becomes a data controller for authentic deeds.
3. Purposes and legal basis of processing
Your personal data is collected and processed for the following purposes:
- Handling your information requests and responding to your contact forms (legal basis: execution of pre-contractual measures at your request).
- Assessing your eligibility for an instalment plan (legal basis: explicit consent).
- Personalising our plot recommendations following your online diagnosis (legal basis: legitimate interest of Capital Foncier in providing personalised service).
- Sending commercial information about new land opportunities, subject to your prior consent (legal basis: consent).
- Statistical analysis of site traffic and improvement of our services (legal basis: legitimate interest and/or consent for non-essential cookies).
- Advisory service orders (plot check, full audit, diagnosis and support of your ACD file): checking our interests before any payment, performing the service, invoicing, optional answer about the land payment, proof of the boxes ticked (accepted terms, start choice) with date and time. Legal basis: performance of the contract and legal obligations.
4. Sharing data with third parties
In the course of our activities, your personal data may be shared with the following categories of recipients:
- Partner notaries: for drafting and securing sales deeds, strictly within the framework of the real-estate transaction.
- Members of the Capital Foncier network (land business managers, diaspora connectors, partner organisations): for site-visit follow-up and commercial support, limited to the information necessary for the service.
- Technical providers: host (Vercel Inc., USA), analytics services (Google Analytics, upcoming), communication tools (WhatsApp/Meta). These providers act as data processors and are contractually bound to protect your data.
- Pre-sale specific recipients: the instrumenting notary, for the notarial escrow and the drafting of authentic deeds, who processes this data under their own responsibility; the land developer, only for the data necessary to carry out the programme.
- Advisory service orders: our bank, Coris Bank International Côte d'Ivoire, for bank transfers; Wave Côte d'Ivoire SA and the partner bank that issues its electronic money, for Wave payments; the administration for a document requested in your name; your identity document is sent to us after payment, by email or in your Investor Space, never before.
Capital Foncier never sells your personal data to third parties. Data sharing is strictly limited to the purposes described above and governed by contractual confidentiality commitments.
5. Data retention period
Your personal data is retained for the period strictly necessary for the purposes for which it was collected:
- Prospect data (diagnosis and contact forms): 3 years from the last contact, in line with ARTCI recommendations.
- Client data (transaction files): 10 years after the end of the contractual relationship, in line with Ivorian accounting and tax obligations.
- Cookie data: 13 months maximum from cookie placement, in line with GDPR recommendations.
- Contractual and accounting documents: legal retention period provided for by Ivorian law (OHADA Uniform Act on accounting law).
- Authentic notarial deeds (land sale, pre-notarial reservation contract, deeds related to securities): thirty (30) years from signature, in accordance with the obligations to retain notary minutes under Ivorian law (Notarial Law).
- Advisory service orders: 10 years after the order (request, accepted version of the terms, start choice, payment, invoice, written report); 3 years for a request sent without payment; 30 days for a request saved and never sent.
6. Your rights
In accordance with Law no. 2013-450 on personal data protection and the GDPR (for EU residents), you have the following rights:
- Right of access: you can obtain confirmation of whether or not data concerning you is being processed, as well as a copy of this data.
- Right of rectification: you can request the correction of inaccurate or incomplete data concerning you.
- Right of erasure (« right to be forgotten »): you can request the deletion of your personal data when it is no longer necessary or when you withdraw your consent.
- Right to object: you can object to the processing of your data for commercial-prospecting purposes at any time.
- Right to portability: you can receive your data in a structured, commonly used and machine-readable format, and transmit it to another data controller.
- Right to restriction of processing: you can request the suspension of the processing of your data under certain circumstances provided by law.

Internal audience measurement (Capital Foncier)
When you consent to analytics cookies, we measure how our public tools (calculators, estimator, lotissement directory, instalment simulator) are used so we can identify which ones are most helpful to you and improve our offering. The collected data is pseudonymised (anonymous session ID), retained for at most 13 months, and processed exclusively by Capital Foncier with no transmission to third parties.

8. International data transfers
As our site is hosted by Vercel Inc. (USA), some of your data may be transferred and stored on servers located outside Côte d'Ivoire and the European Union. Vercel adheres to appropriate safeguards to ensure an adequate level of protection of your data, in line with GDPR requirements.
Likewise, the future use of Google Analytics and the Facebook Pixel will involve data transfers to the United States. These transfers will be governed by standard contractual clauses approved by the European Commission and by any applicable certification mechanism.
Advisory service orders: some hosting and email providers process data outside ECOWAS.
9. Data security
Capital Foncier implements appropriate technical and organisational measures to protect your personal data against any unauthorised access, modification, disclosure or destruction. These measures notably include: SSL/TLS encryption of all communications between your browser and our site, restriction of data access to authorised personnel only, regular data backups and regular updates to our security systems.
Despite these precautions, no transmission or storage system can ensure absolute security. In the event of a personal-data breach likely to result in a high risk to your rights and freedoms, we will inform you as soon as possible, in line with applicable regulations.

Capital Foncier reserves the right to modify this privacy policy at any time to adapt it to regulatory changes or to changes in our data-processing practices.
