Through our land and real-estate intermediation activity, we collect different categories of personal data depending on how you interact with our site and services.
Online forms
When you complete a form on our site (diagnosis form, instalment-plan eligibility form, contact form, information request), we collect the information you voluntarily provide: first and last name, email address, phone number, desired location, budget, professional situation, monthly income (for instalment-plan eligibility) and any other information you choose to share.
Navigation data
When you visit our site, we may automatically collect technical data: IP address, browser type and version, operating system, pages visited, visit duration, traffic source and cookie identifiers. This data is collected via cookies and similar technologies.
WhatsApp exchanges
When you contact us via WhatsApp to obtain information about our plots or services, the exchanged messages, your phone number and your profile name are processed as part of the commercial relationship. These exchanges are subject to WhatsApp's terms of use (Meta Platforms, Inc.).
3. Purposes and legal basis of processing
Your personal data is collected and processed for the following purposes:
- Handling your information requests and responding to your contact forms (legal basis: execution of pre-contractual measures at your request).
- Assessing your eligibility for a bank instalment plan and transmitting your file to our partner banks with your consent (legal basis: explicit consent).
- Personalising our plot recommendations following your online diagnosis (legal basis: legitimate interest of Capital Foncier in providing personalised service).
- Sending commercial information about new land opportunities, subject to your prior consent (legal basis: consent).
- Statistical analysis of site traffic and improvement of our services (legal basis: legitimate interest and/or consent for non-essential cookies).
4. Sharing data with third parties
In the course of our activities, your personal data may be shared with the following categories of recipients:
- Partner notaries: for drafting and securing sales deeds, strictly within the framework of the real-estate transaction.
- Partner banks (SGCI, BICICI, Ecobank, NSIA Banque, BHCI, Coris Bank): only if you have expressly consented to the transmission of your instalment-plan file.
- Partner real-estate agents: for site-visit follow-up and commercial support, limited to the information necessary for the service.
- Technical providers: host (Vercel Inc., USA), analytics services (Google Analytics, upcoming), communication tools (WhatsApp/Meta). These providers act as data processors and are contractually bound to protect your data.
Capital Foncier never sells your personal data to third parties. Data sharing is strictly limited to the purposes described above and governed by contractual confidentiality commitments.
5. Data retention period
Your personal data is retained for the period strictly necessary for the purposes for which it was collected:
- Prospect data (diagnosis and contact forms): 3 years from the last contact, in line with ARTCI recommendations.
- Client data (transaction files): 10 years after the end of the contractual relationship, in line with Ivorian accounting and tax obligations.
- Cookie data: 13 months maximum from cookie placement, in line with GDPR recommendations.
- Contractual and accounting documents: legal retention period provided for by Ivorian law (OHADA Uniform Act on accounting law).
6. Your rights
In accordance with Law no. 2013-450 on personal data protection and the GDPR (for EU residents), you have the following rights:
- Right of access: you can obtain confirmation of whether or not data concerning you is being processed, as well as a copy of this data.
- Right of rectification: you can request the correction of inaccurate or incomplete data concerning you.
- Right of erasure (« right to be forgotten »): you can request the deletion of your personal data when it is no longer necessary or when you withdraw your consent.
- Right to object: you can object to the processing of your data for commercial-prospecting purposes at any time.
- Right to portability: you can receive your data in a structured, commonly used and machine-readable format, and transmit it to another data controller.
- Right to restriction of processing: you can request the suspension of the processing of your data under certain circumstances provided by law.

Likewise, the future use of Google Analytics and the Facebook Pixel will involve data transfers to the United States. These transfers will be governed by standard contractual clauses approved by the European Commission and by any applicable certification mechanism.

Capital Foncier implements appropriate technical and organisational measures to protect your personal data against any unauthorised access, modification, disclosure or destruction. These measures notably include: SSL/TLS encryption of all communications between your browser and our site, restriction of data access to authorised personnel only, regular data backups and regular updates to our security systems.
