The instrumenting notary activates the assignment pact set out in the Conventional Land Security Deed (ASFC): one or more substitution plots affected as security are transferred to you pro rata to the amounts paid in the CARPA escrow account. This is a real-property mechanism (transfer of plot), not a monetary refund. Capital Foncier never has access to your funds — they transit exclusively through the notary.
The ASFC is a notarial deed bundling four overlapping locks on a third-party plot that the operator affects as security for your acquisition (1.5× to 2× ratio): escrow of the original deeds (Art. 1956 Civil Code), synallagmatic promise to assign + irrevocable common-interest mandate (Arts. 1589 and 1984 Civil Code), publication in the Capital Foncier Internal Affectation Register (RAF) for information, and a porte-fort commitment of the operator's directors for non-monetary execution (Art. 1120 Civil Code). If delivery is not duly recorded, the notary transfers these substitution plots to the buyers.
